CDA (Capital Development authority) is responsible for the smooth construction operations in Capital Islamabad. It is authorized to issue and cancel the NOC of any housing society within the premises of Islamabad. So, in October 2020, CDA declared many renowned housing societies illegal. The further development and construction in the societies ceased under the Amendments in the ICT Zoning Regulations of 1992. The amendments cover certain points which are enough to declare any society illegal.

What Makes a Society Legal/illegal according to CDA?

  • Society does not include any necessary amenities like mosques, schools, hospitals, and parks.
  • If the society has not applied for the NOC over a long time period.
  • If the land is illegally occupied.
  • If any society has started to expand its projects to zone 3.

In all the above-mentioned and other complicated situations, CDA sends a notice to the Housing society to stop any kind of development activities and to put a full stop to all marketing campaigns for further plot bookings. Ghauri Town (Phases in Zones IV and V)

Whenever we talk about Ghauri Town, we know that we are talking about a fully functional and delivered housing society in Islamabad. But to our shock, it is an illegal society. This illegally declared town has nearly150,000 resident families. But if you have a look at its master plan or layout, you will find out that it was never designed according to CDA’s standards.

CDA has declared all the phases in zone 4 and 5 to be illegal because the masterplan does not include any basic and necessary amenities like recreational areas, parks, educational institutes, praying areas, hospitals, graveyards, or any amenity plots. The plan or design of this society is not designed to provide the residents with standard living but unfortunately just to earn double the amount of profit by allotting the whole area as residential plots.

Ghauri Town’s developers are issued with an illegality notice to discontinue every sort of construction and not to promote it anymore. File selling and bookings are not allowed as per law.

National Police Foundation

National Police Foundation is also one of the renowned societies in Islamabad. It was declared an illegal society by CDA in 2011 when some of the agents were caught selling the plots more than the land area they had acquired. Also, the National Accountability Bureau (NAB) ran a detailed investigation against the plots sold by the Police Foundation. 

People planning to start construction on the purchased land are forbidden to do so. The NOC of the land got canceled and they are no more allowed to develop the society or sell any kind of plots. 

Doctors Enclave (Simly Dam Road, Zone IV)

Doctors Enclave is located in zone 4 of Islamabad which is now a sort of hub of illegal housing societies. Nearly 60 illegal societies are built there. Doctors Enclave is one of them. Residents of Islamabad would be surprised after knowing the fact that there are a total of 140 illegal and only 64 legal housing schemes in Islamabad. 

Doctors Enclave also got an illegality declaration because the management did not apply for the registration or NOC from CDA. This fact makes CDA question the standards and operations of the society’s management.

Arcadia City Housing Scheme (Zone III)

In 2014 the Arcadia City Housing Scheme located in zone 3 of Islamabad was declared illegal. It got the illegality notice because according to the ICT Zoning Regulation of 1992, no one is allowed to build residential projects in Zone 3 of Islamabad. The Arcadia City Hosing scheme directly violated the rule and was declared illegal. 

Another notice has been issued to the housing society to stop all the marketing activities like sales bookings, advertisements, and sales marketing. 

Pakistan Town Phase II

In 2018 CDA got to know that many of the societies in phases 3, 4, and 5 in Islamabad are fully developed but do not meet the standards issued by the authorities. The same is the case with Pakistan City Phase 2 Islamabad. The society has not applied for the NOC and they haven’t even asked for the registration application. 

It is a major point that has got society management in trouble. Because they were not issued any time to apply for the NOC. Any society that does not bother to apply for NOC has definitely something to do with any illegal activity going on or they are seeking an escape from registration and NOC taxes and fees.

Bahria Enclave-I (Kurri Road)

Bahria Enclave is the name of one of the most respected housing societies in Pakistan because of its owner and developers. But to your information Bahria Enclave 1 which is located on Kurri Road is declared illegal by CDA. 

CDA issued them an illegality notice in coherence with Section 49-C of the CDA Ordinance. CDA authorities have ordered Bahria Enclave to forfeit the area of 510 Canal and 6 Marla to CDA. Because after the investigations it got proved that possession of 510 Kanal and 6 Marla is illegal and they cannot continue any sort of development and marketing activities here.

Muslim Town (Simly Dam Road, Zone IV)

In 2017 CDA declared Muslim Town in zone 4 of Islamabad to be illegal. Just like Pakistan Town, they also had not applied or did not have any intentions to apply for registration and NOC. It is one of the societies which did not bother to ask for any development project’s permission before starting the construction. 

Just like Muslim Town Islamabad, many other housing societies are built illegally, have no other consents to develop further, and have been told to cease all marketing and selling operations.

Role of CDA 

CDA has taken strict actions against the illegal housing societies in Islamabad. These steps are important to be taken in order to avoid the violence of the law and to avoid the exploitation of citizens’ rights. All the actions are majorly taken for not applying for NOC and registration or the societies are violating the rules by possessing others’ land area. CDA has worked remarkably for the real estate industry in the capital.
